This is in response to the letter from Barbara Jones, "No Persecution." As the state-certified building official for the city of Dunedin, it is my duty to uphold and enforce the state building code and city ordinances. Since the Statewide Florida Building Code was created, new and replacement windows and exterior doors have been required to be permitted and inspected in order to resist high winds generated by storms. Permits are also required by the city of Dunedin.
It was brought to my attention this past fall that many condominium units throughout the city have had replacement windows installed without permits. Therefore, I have tasked my staff with identifying those units and addressing them as needed. Replacing windows without a permit is illegal. Permits and inspections by trained professionals are the manner in which public safety is best assured.
We are sending letters to each homeowners' association and property management, asking them to stop their owners installing windows and doors without a permit. As common property, the exterior of a condominium is controlled by the association, which is responsible for construction activity related to that exterior, including windows and doors. In the event of a catastrophic storm, these condominiums, many of which are multistory, could see any illegal windows and doors adversely affect other living units when subpar materials and installations fail.
As a public official, it is my duty to save and protect lives by enforcement of local and state building codes.
